Gagging Order Imposed On Probiotics – More Nutrients and Supplements Soon To Follow

The ANH also warned that the 2006 EU Nutrition and Health Claims Regulation could be exported around the world and noted the Codex Alimentarius Commission, the World Health Organization (WHO) body that recommends food codes internationally, favoured the European system.
The voluntary UK advertising watchdog, Advertising Standards Agency (ASA), has told Danone to cease broadcasting TV adverts that state its one-shot probiotic drinking yoghurt, could boost the immune system of children...
That’s right. We are no longer allowed to know when something natural is good for us or our children!
Following on from yesterday’s alert, Herbal Medicine, Acupuncture and Traditional Chinese Medicine Under Threat in the UK, the Daily Health can reveal today that our ability to gain access to information about the health benefits of nutritional supplements and various foods is also under serious threat.
Worse still, many supplements could disappear from health food store shelves completely or be available in such small dosage amounts that they are rendered almost completely useless in the fight against serious illness. More on that later...
For now let’s take a closer look on the Danone situation.
Not a healthy gut-feeling
The ASA was happy with previous evidence submitted by Danone, that Actimel had a proven probiotic effect. Yet, in spite of this acknowledgement of its benefits they maintained that evidence submitted by Danone, including recently conducted studies, did not support the claim that Actimel was ‘Scientifically proven to help support your kids’ defences’.
A spokes person for Danone said: ‘Our scientific claims are sound and based on a large body of evidence... We have 24 published clinical studies all of which demonstrate Actimel’s positive health benefits, in a variety of circumstances, on a range of people – from children to the elderly. These studies are designed and approved by a board of internationally recognised experts with extensive, directly relevant experience in human clinical trials, effects of probiotics in the gut, paediatrics and immunology.’
Tip of the iceberg
All of this has happened in the wake of the October 1 publication of about 500 health claim opinions by the European Food Safety Authority (EFSA) which stunned the industry with a 70 per cent failure rate.
Not a single botanical or probiotic claim drew a positive opinion. What this means in layman’s terms is that 523 (to be precise) botanicals and probiotics need to change their marketing with reference to the way they make claims about the benefits of these products and nutrients, or else they will not be allowed to go on store shelves (or like we’ve seen with Danone, to advertise their products).
Some of the food and supplements that are affected by the EFSA negative claim opinions are folate (foetal and infant development), Omega-3 (some aspects of heart health), glucosamine and chodroitin (joint health). It is becoming more and more apparent that the 2006 Nutrition and Health Claims Regulation is going to deliver a highly restrictive health claims regime – perhaps the most restrictive in the world...
The European Commission has now set themselves the goal to process all the health claim opinions issued by EFSA, by the end of January 2010. This means that the effects on supermarket shelves and health food stores will be felt by us, as early as July 2010.
Up for a BIG fight
Earlier this week Dr. Robert Verkerk of the Alliance for Natural Health (ANH), said the European Union health claims system is going way beyond its responsibility to protect consumer interests and the scientific stance being taken by EFSA added up to a gagging of free speech.
Dr. Verkerk also said it is time for a call-to-action and added: ‘I don’t believe the food and supplement industry, or scientists, can accept a good number of these opinions lying down... We feel that, in time, once the full impact of the EU Regulation is felt in the EU -in 2011 and after - legal challenges centering on the infringement on our fundamental rights and freedoms may become a necessity.’

Finally Dr. Verkerk said: ‘We must remember that this new claims environment affects not only labels and supporting marketing material, but also the spoken word. Act now to safeguard your right to choose
If we are complacent about these matters, the world as we know it and the way we take care of our health will change rapidly and in a way we won’t like. Below are some points of action you can take to have your voice heard. If you have not already signed the petitions listed below (details were included in yesterday’s alert), do it today.
1. Dr. Robert Verkerk from Alliance for Natural Health has set up a petition - Unfair EU Restrictions on Vitamin & Mineral Levels - which he will present to the European Commission to stop Codex. Dr. Verkerk is the one man we have on our side to make our voices heard. I urge you to sign his petition, it carries almost 16,000 names at the moment. It is a European petition so the entire continent can put there names down. Sign it today!
Unfair EU Restrictions on Vitamin & Mineral Levels
2. You can also write a letter to the President of the European Commission, José Manuel Barroso (particularly in matter pertaining the rulings of EFSA). I have it on good authority that his team brings important issues to his attention. Writing a letter may seem like a laborious job, but if it’s for the future of the planet, 10 minutes is surely not too much to ask. In fact all you have to do is follow the link below, print the template letter out, fill in the date, sign the letter and post it. Do it today!
