EU Supplement Crackdown: Time is Ticking Away... Your Freedom to Choose is in Jeopardy

The threat to lose our right to choose the way we want to take care of our health is real and it is global. The model of restrictions and regulations followed and implemented in Europe has been agreed by the governments of the US, Canada and Australia. Other governments that want to be seen as major players will almost certainly follow their lead...
In last week’s alert, 'Are You Taking ‘Illegal Drugs’ for Your Health, Without Knowing It?', I told you about the European Union’s (EU) restrictive Traditional Herbal Medicinal Products Directive (THMPD).
For those of you who missed that alert, here’s a quick recap. When the THMPD is fully implemented in April 2011 thousands of natural products distributed by specialist herbal suppliers will become increasingly difficult, if not illegal, to sell.
Many of you wrote in expressing your concern and outrage about the THMPD. However, despite feeling this way some of you believe that you simply don’t have the power to make a difference... You do! but more on that a bit later.
Don’t be fooled and Don’t give up
One of our readers in the US wrote and said “Why are you talking to me about something that is happening in Europe? This will never affect America.”
The threat to lose our right to choose the way we want to take care of our health is real and it is global. Other governments that want to be seen as major players will almost certainly follow their lead...
This blueprint is being helped along by intergovernmental processes both 'formal', through Codex Alimentarius - the intergovernmental food standards body that is coordinated by the Food and Agricultural Organization and the World Health Organization; and 'informal', through backroom deals.
For example, in June 2009, the American Food and Drug Administration (FDA) revoked their own previous approval of a health claim concerning the role of the trace mineral selenium in reducing the risk of cancer.
Selenium is present in almost every cell in your body, certain areas such as the kidneys, spleen, liver and pancreas have richer amounts of selenium.
If you lack selenium in your body, it may cause cancer, cataracts, heart disease, growth retardation, muscle cramps, heart enlargement and even abnormalities on your nail beds. So, it's vital that your diet contains foods that are known to be good sources of selenium.
Luckily, on 27 May 2010, the District Court of Columbia, in the US, ruled that the FDA’s decision was unconstitutional to require ‘conclusive’ evidence for a health claim. The court also recognised the fact that almost no health relationships can be proven conclusively or unequivocally.
This may look like a small victory, but it is an important one because government agencies and bureaus have the ability to make rules without reference to the democratic process. The FDA’s decision on selenium is one of thousands of such rules made each year – the vast majority pass uncontested.
One man who decided enough is enough and took a stand, is the owner of a natural medicine clinic, Phillip Franco. He staged a one-man protest on 7 September 2010 in Port-of- Spain, Trinidad, in the Caribbean, against the practices of the ministry’s Food and Drug Division (F&D).
Franco has a shipment of digestive enzymes and flaxseed oils which has been awaiting approval by the F&D since August 26. Franco described the F&D as operating as a “law unto themselves. When they tell you no, what recourse do you have?” He also listed the F&D’s actions as having a prohibitive and unfair registration process for herbal and alternative medicine, lack of accountability and transparency, unnecessary sample taking, unreasonable labelling requirements, lack of consistency, not to mention the oppressive attitude of F&D staff.
Bravo Franco!
Being off guard in these times is simply not an option
If we want to stem the tide of unjust laws affecting natural medicine, we have to make our voices heard.
The way things are going, all generic health claims run the risk of being banned unless they are specifically approved. Approved by who, you ask?
Yet again, it is an unelected bureaucratic agency, in this case the European Food Safety Authority (EFSA).
It is important to note that the EFSA does not reject or approve any claims as such but indicates whether the outcomes of the evaluation were favourable (positive) or unfavourable (negative). Once the EFSA have evaluated each claim and published their opinion (positive or negative) on each supplement and herbal remedy, it is then submitted to the European Commission. The EU commission then enforces these opinions through the Traditional Herbal Medicinal Products Directive which can either be accepted or rejected by the member states of the European Union (EU).
That’s why it’s so important to contact your MP now before it is too late... your government still has the power to influence which products stay and which go... Once accepted, these restrictions are implemented and become law... and as they say... the rest will be history...
Similar scenarios, with similar restrictions and outcomes will follow in America, New Zealand and Canada.
You can stop this process from making a bad turn by getting actively involved. Write to your parliamentary representative today and help stop these draconian measures from being implemented before it is too late.
